PURCHASE POLICY


Our goal is to make your purchasing experience easy, efficient and equitable, so we can get you on your way to your movie show or other events as quickly as possible. The following is designed to ensure your satisfaction and understanding of the purchase process on the Justickets sites and applications where this appears, including sites and applications where we facilitate ticket resale transactions (collectively, the "Site"). If you have any questions, please contact us. Your purchases on our Site are subject to these terms. Please also review our Terms of Use, which govern your use of our Site.

CURRENCY

All ticket prices are stated in Indian Rupees (INR).

PAYMENT METHODS

Justickets accepts payments through Visa, MasterCard, select Debit Cards, Net Banking, and the Justickets Wallet to accommodate your needs. Other payment methods may be added from time to time.

WHO YOU ARE BUYING FROM

Justickets acts as the agent to those who provide event services, including, but not limited to movie tickets (herein referred to as "Event Providers"). When you purchase a ticket for an event, then Justickets will act as an intermediary, handling the transaction as well as collecting payment for the Event Provider. Furthermore, Justickets is under no obligation to monitor the merchant establishment's service used by you; the merchant establishment alone will be responsible for all obligations under the contract including (without limitation) warranties or guarantees. Any dispute with or complaint against any merchant establishment must be directly resolved by the Customer with the merchant establishment. It is also clarified that Justickets shall not be responsible or liable for any deficiency in services purchased using the Justickets Wallet. This exclusion of liability shall apply even for services made available by Justickets under promotional schemes. You are instructed to satisfy yourself regarding the quality, quantity and fitness of any service before purchasing the same.

Any amount transferred erroneously by the Customer to any merchant establishment shall not be refunded to the Customer by Justickets in any circumstances.

In the event of any dispute, Justickets records shall be binding as the conclusive evidence of the transactions carried out through use of Justickets website through any of the payment modes described above.

Justickets shall send all customer communications by SMS and/or email and the SMS shall be deemed to have been received by you after they have been submitted for delivery to the mobile phone operator.

You agree to receive all commercial messages including transactional messages from Justickets.

PRICING AND AVAILABILITY

We sell movie tickets on behalf of Event Providers, which means we do not set the ticket prices or determine seating locations. Event Providers may choose to show only the base ticket price (i.e., without applicable taxes) while selecting seats on the Site. However, applicable taxes will be collected at the time of making payment by you. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the services. Further, you shall be responsible for any increase in the price charged by Event Providers on account of change in rate of taxes or imposition of new taxes by the Government. Tickets are generally sold through several distribution points including online. Most distribution points generally access the same ticketing system and inventory. Therefore, tickets for popular events may sell out quickly. You can avail the facility of the Booking Assistant provided by us.

ORDER CONFIRMATION

If you do not receive a confirmation number (in the form of a confirmation SMS or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with Justickets Customer Service whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. Justickets will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.

We never ask for any sensitive account/card information (except in the transaction page when you book Ticket(s)) and request you not to share the same with any third party. Justickets shall not be held responsible for any losses arising as a result of you sharing your personal/sensitive information with a third party.

SERVICE FEES AND ORDER PROCESSING FEES

Tickets purchased on our Site are typically subject to a per-ticket service fee and a non-refundable per-order processing fee. In many cases, delivery prices will also be owed. You may be able, in some instances, to purchase tickets directly from the venue box office without paying our service fee. For resale tickets, the buyer will pay fees that may be reflected during the purchase process.

NUMBER OF TICKETS OR "TICKET LIMITS"

When purchasing tickets on our Site, you are limited to a specified number of tickets for each event (also known as a "ticket limit"). This ticket limit is posted during the purchase process and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices. We reserve the right to cancel any or all orders and tickets without notice to you if you exceed the posted limits. This includes orders associated with the same name, e-mail address, billing address, or other information.

TICKET TRANSFER

We may cancel transferred tickets if they were obtained fraudulently or otherwise in violation of our policies. If a movie is cancelled or rescheduled, only the original purchaser will be eligible for a refund.

CANCELLED AND RESCHEDULED EVENTS

Occasionally, movies may be cancelled, advanced or postponed. Should this occur, we will attempt to contact you to inform you of schedules or refund procedures for that movies.

If a movie is cancelled, and you purchased your ticket through Justickets we will automatically issue you a refund to the credit card, debit card, Internet banking account or any other payment method that you used to purchase that ticket.

REFUNDS AND EXCHANGES

Before purchasing tickets, carefully review your movie and seat selection. Policies set forth by Event Providers generally prohibit us from issuing exchanges or refunds after a ticket has been purchased, or for lost, stolen, damaged or destroyed tickets.

TERMS OF USE FOR CLOSED WALLET

The following Terms of Use (“Terms”) are a binding agreement between you and Justickets Private Limited. By registering for or using the site or the platform/network, you agree to be bound by these terms. If you do not accept these terms, please do not use the site or the platform/network.

Definitions

- "Customer" means a person who has registered with Justickets and/ it's partner sites, for availing our services using the Justickets Wallet and who has accepted these Terms and Conditions and, owns/operates/has access to an Internet compatible device that supports the Justickets Wallet.

- "Justickets Wallet" means the pre-paid payment instrument issued by Justickets.

- "Charge(s)" or "Service Charge" shall mean the charges, which Justickets may levy upon you in consideration for subscribing to the Justickets Wallet.

- "Account" means Customer Justickets Wallet classified as Closed System payment instruments issued by accepting minimum customer details being Customer Name, Email Address, Mobile Number, which permit payment and domestic money remittance as per RBI direction on Issuance and Operation of Pre-paid Payment Instruments in India (Reserve Bank) Directions, 2009 as amended and supplemented by the RBI from time to time.

- "KYC" stands for Know Your Customer and refers to the various norms, rules, laws and statutes issued by RBI from time to time under which Justickets is required to procure personal identification details from you before any services can be delivered. Know Your Customer (KYC) documents may be required by Justickets from the Customer at the time of Registration and/or on a later date, for availing and/or continuation of the Justickets Wallet.

- "Password" means the secret password used to secure Justickets Wallet applications, without knowledge of which you will be unable to operate or use your Justickets Wallet.

- "Transaction" means purchase of a service through the Justickets website.

- "RBI" means the Reserve Bank of India.

Documentation

The collection, verification, audit and maintenance of correct and updated customer information is a continuous process and Justickets reserves the right, at any time, to take steps necessary to ensure compliance with all relevant and applicable KYC requirements. Justickets reserves the right to discontinue services / reject applications for Justickets Wallet at any time if there are discrepancies in information and/or documentation provided by you.

Any information provided to Justickets with the intention of securing Justickets Wallet shall vest with Justickets, and may be used by Justickets, for any purpose consistent with any applicable law or regulation, at its discretion.

If the particulars provided by you in the KYC documents do not match with the details mentioned in the Enrolment Form, then Justickets has the right to forfeit the balance amount in your wallet.

General Conditions of Justickets Wallet

You will be issued the Justickets Wallet Account on successful registration.

You may recharge your Justickets Wallet at or through any of the methods viz., our website, our apps, retail agents and/ issuers outlets against cash/debit cards/credit cards. The list of recharge methods to recharge the Justickets Wallet is subject to change at the discretion of Justickets without prior intimation to the Customer.

You may note that withdrawing money from the Justickets Wallet is not allowed. Any outstanding credit on Justickets Wallet must be utilized only to make payments for bona-fide transactions of purchasing tickets through Justickets Website or its apps. Justickets Wallet is available only to Resident Indians who have attained the age of 18 years and are competent to contract.

The services or any wallet holder's Justickets Wallet is not transferable.

The amount that can be deposited in the Justickets Wallet is governed by policies laid down by RBI. These involve monthly limits, transaction limits as well as balance limits on the Justickets Wallet. The maximum monetary value that can be stored at any point of time in a Justickets Wallet Account is INR 5,000/- (Five Thousand Indian Rupees only). The maximum permitted value of Transactions at any point of time in Justickets Wallet Account is INR 5,000/- (Five Thousand Indian Rupees only). This Wallet cannot be used for purchase of any other prepaid instrument. Subject to guidelines / notifications issued by RBI from time to time these limitations may be reviewed and modified at the discretion of Justickets without prior intimation to the Customer.

Justickets reserves the right to suspend/discontinue Justickets Wallet Services to you at any time, for any cause, including, but not limited, to the following:

- For any suspected violation of the rules, regulations, orders, directions, notifications issued by RBI from time to time or for any violation of the terms and conditions mentioned in this document

- For any suspected discrepancy in the particular(s), documentation or Enrolment Form provided by you;

- To combat potential fraud, sabotage, wilful destruction, threat to national security or for any other force majeure reasons, etc.;

- If the same is due to technical failure, modification, upgradation, variation, relocation, repair, and/or maintenance due to any emergency or for any technical reasons.

- If the same is due to any transmission deficiencies caused by topographical and geographical constraints/limitations;

- If the mobile connection with which your Justickets Wallet is related ceases to be operational or in your possession or control.

- If Justickets believes, in its reasonable opinion, that cessation/ suspension is necessary.

The value stored on your Justickets Wallet shall NOT be refunded under ANY circumstances and may only be utilized to make payments for bonafide transactions of purchasing tickets through Justickets Website or its apps. No interest will be payable by Justickets on the available balance reflected on the Justickets Wallet. No cash withdrawal is permissible on the Justickets Wallet.

You are permitted to maintain and operate only one Justickets Wallet. Any suspected non-conformity with this requirement shall be just cause for the suspension/ discontinuation of any/all Justickets Wallets associated with you by Justickets.

Justickets Wallet Charges & Validity

You shall pay the Service Charges prescribed by Justickets in the form and manner prescribed for such payment. Justickets may at its discretion, change, amend, increase, or reduce the Service Charges without prior intimation to the Customer.

Any value in your Justickets Wallet that is utilized towards making payments for any Transaction shall be automatically debited from your Justickets Wallet. Justickets' responsibility is limited to the debiting of your Justickets Wallet and the subsequent payment to any merchant establishment that you might transact with. Justickets does not endorse, promote, champion or warrant any goods and/or services that might be bought/availed or proposed to be bought/availed using Justickets Wallet.

Justickets reserves the right to levy charges/charge commissions upon any amounts loaded upon your Justickets Wallet or any amounts spent/utilized by you using Justickets Wallet.

Justickets reserves the right to set off any balance in your Wallet in order to recover funds for transactions processed as per your request.

Redemption and Forfeiture

Any value in Your Justickets Wallet must be utilized within 1 year from the date of activation.

Any value in your Justickets Wallet that is not utilized in the aforesaid manner may stand forfeited at the discretion of Justickets. Justickets reserves the right to forfeit the amount with adequate intimation sent to the Customer.

Customer Obligations

Justickets Wallet availability is subject to the maintenance of an active mobile phone or Internet connection with an associated telecom provider. Justickets Wallet availability is subject to the maintenance of a mobile phone handset and other application on which Services run and the Customer is solely responsible for all liability arising from the unavailability of Services due to a mobile handset or Internet service provider not supporting any Justickets Wallet channel or application.

You must ensure the availability of sufficient funds before executing any Transaction from your Justickets Wallet.

You shall be solely responsible for the confidentiality, safety and security of the Password. You shall be the sole owner of the Password and shall be responsible for the consequences arising out of disclosure of the Password and/or the unauthorized use of Justickets Wallet. In case the Password is lost or misplaced, you shall promptly use the Forgot Password feature provided on your Justickets profile. In case the mobile phone/SIM card associated with your Justickets Wallet is lost/stolen/misplaced/ no longer in your control, you shall promptly update and verify the same on your Justickets profile. You shall only use Justickets Wallet for Transactions on Justickets.

You shall intimate Justickets about change in your address, if any, in writing along with such proof of address as per the KYC documents.

You shall not use Justickets Wallet for any purpose that might be construed as contrary or repugnant to any applicable law, regulation, guideline, judicial dicta, Justickets policy or public policy or for any purpose that might negatively prejudice the goodwill of Justickets.

You acknowledge and understand that Justickets Wallet are linked to your mobile phone number and you shall be solely responsible for any liability arising out of the loss/ theft/misuse of the mobile phone number or deactivation of mobile connection by the concerned telecom service provider, in respect of the Services.

Information submitted by you for availing Justickets Wallet and/or information submitted while using Justickets Wallet may be shared with third parties by Justickets, inter alia, to facilitate the provision of Justickets Wallet.

You shall ensure that the Services are not used for Transactions in foreign currency. Justickets Wallet is issued & shall be valid only in India and shall be used at merchant establishments only in India.

Justickets Booking Assistant

Ticket will be booked on the user's behalf on a best-effort basis and cannot be guaranteed in any way.

Seats will be chosen for user based on availability and the user cannot choose to change his/her seats.

The ticket allocation is purely subject to availability for the show requested.

There will be an additional convenience charge per transaction for this service based on the theatres chosen by the user.

Order confirmation depends entirely on release date of the movie and theatre schedules.

Cancellation of your Movie Ticket is subject to the discretion of the theatre management. To avail cancellation, you must be logged in to your Justickets account during both the booking and cancellation processes.

If the theatre cancels the user's ticketed show, the user's wallet will be refunded and a new ticket will NOT automatically be booked for him/her.

Justickets shall hold the money received in exchange of the assisted booking order in the user's wallet until the booking is confirmed/ticket has been issued.

Justickets is not liable for any damages due to non-availability of tickets, non-allotment, postponement of movie release, cancellation of shows or cancellation of movie release.

If you do not receive a confirmation number in the form of a confirmation email or SMS after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm the same in your booking history and to call the customer service department to ensure the Justickets Booking Assistant order has been placed.

Justickets is not responsible for exchanges or refunds after a ticket has been purchased, or in the event that it has been lost, stolen, damaged or destroyed.

Compliance with Law

The Justickets Wallet is governed by per RBI direction on Issuance and Operation of Pre-paid Payment Instruments in India (Reserve Bank) Directions, 2009 (as amended and supplemented from time to time) and is also subject to directions / instructions issued by the RBI from time to time in respect of redemption, repayment, usage etc. Justickets will not be responsible or liable for any violation by you of applicable law, regulation, or guideline. You hereby declare that your name does not, at any time, appear in the consolidated list of terrorist Individuals/organizations as circulated by the RBI from time to time.

Third Party Wallet

It is further explicitly clarified that You and the respective Wallet Service Provider shall execute an Agreement detailing out the terms and conditions more specifically concerning monies, the payment mechanism, commercials pertaining transactions, etc.

Although each of the Wallet Service Providers shall contain their respective terms and conditions which shall be inclusive of these Terms in light of which You explicitly agree and acknowledge that the Terms and Terms of Use set out herein above and any specific literature pertaining to any and all Promotions shall be construed harmoniously and in-conjunction with these Terms and these Terms shall supersede and prevail in the event of any conflict and dispute with any of the Wallet Service Provider (jointly and/or severally) (including but not limited to the corresponding terms and conditions of each Wallet Service Provider) and this Terms shall prevail.

For the purposes of this Clause:

“Wallet” means a pre-paid payment instrument which is associated with the Services and Your account.

“Wallet Service Provider” shall mean and include PayU Payments Pvt Ltd, One97 Communications Ltd One MobiKwik Systems Pvt Ltd, etc which owns the brand PayU Money, PayTM, MobiKwik respectively and such other providers which may be enlisted by Us from time to time.

Confidentiality

Privacy of communication is subject to the terms of the certificate of authorization granted by the RBI and RBI notifications/directives etc. You specifically agree that in order to facilitate the provision of Justickets Wallet, Justickets may be required to disclose any information or particulars pertaining to you to any authority, statutory or otherwise.

Grievance Officer

The Customer has the right to register their complaint if they are not satisfied with the services or finds attitudinal deficiencies when dealing with agents/staff or finds system errors or sees gaps between standards of service promised and actual service rendered by the company.

The Customer can lodge a complaint by sending email to support@justickets.in. This mechanism is exclusively dedicated for customer complaint redressal.

Acknowledgement of Grievances & Redress on Complaints:

1. Justickets will acknowledge the grievance immediately on the receipt of complaint and initiate action to have the grievance resolved within a maximum period of three weeks on extraordinary cases with auto reply in either cases.

2. The Customer will also be kept informed of the action taken, the progress while redressing grievances, and/or, the reasons for delay if any, in redressing.

3. Complaints received by e-mail shall be acknowledged by an immediate system generated response or via individual emails to the extent possible.

4. The follow up action taken in respect of such complaints shall be advised to customers by e-mail or over phone.
